Terms & Conditions

Last Updated: September 24, 2026

1. Agreement to These Terms

These Terms & Conditions (“Terms”) are a legally binding agreement between you and Nationwide Advance (“Nationwide Advance,” “we,” “us,” or “our”). They govern your access to and use of nationwideadvance.com, any related forms, applications, communications, and services (together, the “Services”). By accessing the Services, submitting an application or form, providing your contact information, or clicking a button or checking a box that references these Terms, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

PLEASE READ SECTION 13 CAREFULLY. IT REQUIRES DISPUTES TO BE RESOLVED BY INDIVIDUAL BINDING ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

2. Eligibility and Authority

(a) You must be at least 18 years old to use the Services.
(b) The Services are offered solely for business and commercial purposes. They are not offered for personal, family, or household purposes.
(c) If you use the Services on behalf of a business, you represent and warrant that you are an owner or authorized representative of that business with authority to bind it to these Terms, and “you” includes both you and that business.

3. Our Role: We Are a Broker, Not a Lender

(a) Nationwide Advance is a commercial financing broker. We are not a lender, funder, or bank, and we do not make credit or funding decisions.
(b) We help connect businesses with third-party funding providers (“Funders”), which may offer merchant cash advances, revenue-based financing, business loans, lines of credit, equipment financing, or other commercial financing products. Many of these products, including merchant cash advances, are not loans.
(c) Submitting an application does not guarantee approval, an offer, any particular amount, rate, cost, or term, or any funding. All approvals, offers, terms, and funding are determined solely by the Funder, and any funding agreement is solely between you and the Funder.
(d) We may receive compensation from Funders or other third parties in connection with transactions arising from your application. Compensation may vary by Funder and product.
(e) We do not provide legal, tax, accounting, or financial advice. You should consult your own advisors before entering into any financing agreement.

4. Information You Provide; Authorization to Share and Verify

(a) You agree that all information you provide to us, including applications, bank statements, tax documents, and ownership information, is true, accurate, complete, and not misleading, and you will promptly update it if it changes.
(b) You authorize Nationwide Advance to share your application, documents, and related information with Funders, their agents, and our service providers for the purpose of evaluating, offering, underwriting, and servicing financing for your business.
(c) You authorize Nationwide Advance, Funders, and their agents to obtain business and personal credit reports on your business and on its owners and guarantors, to verify information with banks, credit bureaus, landlords, and other third parties, and to obtain bank-account and transaction data you authorize, in each case in connection with your request for financing.
(d) Providing false or misleading information may result in denial of your application and may be reported as required by law.

5. Consent to Calls, Text Messages, and Email

(a) By providing your phone number and/or email address through the Services, you expressly consent to receive calls, text messages (SMS/MMS), and emails from Nationwide Advance and Funders at the number and address you provided, including marketing messages and messages sent using automated technology, an automatic telephone dialing system, or artificial or prerecorded voice. Your consent is not a condition of purchasing any goods or services.
(b) Message frequency varies. Message and data rates may apply. Reply STOP to any text message to opt out of texts. Reply HELP for help, or email admin@nationwideadvance.com. You may also revoke consent by any reasonable means, including by emailing admin@nationwideadvance.com.
(c) Wireless carriers are not liable for delayed or undelivered messages.
(d) You represent that you are the subscriber or customary user of the phone number you provide. You agree to notify us promptly if you give up that number.
(e) Your mobile information will not be sold or shared with third parties for their promotional or marketing purposes, except as described in Section 4(b) for the purpose of arranging financing you requested.

6. Acceptable Use

You agree not to: (a) use the Services for any unlawful, fraudulent, or unauthorized purpose; (b) submit information about a business you are not authorized to represent; (c) impersonate any person or entity; (d) interfere with, disrupt, scrape, crawl, or attempt to gain unauthorized access to the Services or related systems; or (e) upload viruses or other malicious code.

7. Intellectual Property

All content on the Services, including text, graphics, logos, trademarks, images, video, and software, is owned by or licensed to Nationwide Advance and protected by copyright, trademark, and other laws. You may view the Services for your own business purposes only. You may not reproduce, distribute, modify, create derivative works from, or publicly display any content without our prior written consent.

8. Third-Party Websites and Services

The Services may contain links to, or integrate with, third-party websites and services, including those of Funders. We do not control and are not responsible for their content, terms, privacy practices, or products. Your dealings with any third party are solely between you and that third party.

9. Disclaimer of Warranties

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. INFORMATION ON THE SERVICES IS FOR GENERAL INFORMATIONAL PURPOSES ONLY AND IS NOT AN OFFER OR COMMITMENT TO PROVIDE FINANCING.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (a) NATIONWIDE ADVANCE AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE SERVICES OR ANY FINANCING OBTAINED OR NOT OBTAINED, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (b) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). WE ARE NOT RESPONSIBLE FOR THE ACTS, OMISSIONS, DECISIONS, OR PRODUCTS OF ANY FUNDER.

11. Indemnification

You agree to defend, indemnify, and hold harmless Nationwide Advance and its owners, officers, directors, employees, agents, and affiliates from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) any information you provide; (c) your violation of these Terms or any law; or (d) your violation of any third party’s rights.

12. Governing Law

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of New York, without regard to its conflict-of-laws rules, except that Section 13 is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq. (“FAA”).

13. Dispute Resolution: Binding Arbitration, Class Action Waiver, and Jury Waiver

(a) Informal resolution first. Before starting any arbitration or court proceeding, the party raising a dispute must send written notice describing the dispute and the relief sought. Notices to us go to admin@nationwideadvance.com. The parties will try in good faith to resolve the dispute for 30 days after notice is received.

(b) Agreement to arbitrate. Except as provided in Section 13(e), any dispute, claim, or controversy between you and Nationwide Advance arising out of or relating to these Terms, the Services, any communications (including calls, texts, and emails), or the relationship between us, whether based in contract, tort, statute (including the Telephone Consumer Protection Act), or otherwise (“Dispute”), will be resolved exclusively by final and binding arbitration. The arbitrator, not any court, has exclusive authority to decide all issues about the scope, validity, enforceability, and arbitrability of this Section 13, except as stated in Section 13(d).

(c) Arbitration procedures. Arbitration will be administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules then in effect, before a single arbitrator. The seat of arbitration will be New York County, New York, though hearings may be held by video conference. The arbitrator may award any individual relief available in court, subject to these Terms. Judgment on the award may be entered in any court of competent jurisdiction.

(d) Class action waiver. YOU AND NATIONWIDE ADVANCE AGREE THAT EACH MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims of more than one person or preside over any class or representative proceeding. If a court finally determines that this class action waiver is unenforceable as to any claim, that claim (and only that claim) will be severed and heard in court under Section 13(f), and will be stayed pending arbitration of any remaining individual claims.

(e) Exceptions. Either party may (i) bring an individual action in small claims court for Disputes within that court’s jurisdiction, and (ii) seek temporary or preliminary injunctive relief in court to protect intellectual property or to prevent unauthorized access to the Services.

(f) Courts and venue. For any Dispute not subject to arbitration, and for any action to compel arbitration or to confirm, modify, or vacate an award, you and Nationwide Advance consent to the exclusive jurisdiction and venue of the state and federal courts located in New York County, New York, and waive any objection based on inconvenient forum.

(g) Jury waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND NATIONWIDE ADVANCE EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY DISPUTE.

(h) Time limit. Any Dispute must be commenced within one (1) year after the claim arises, or it is permanently barred, to the extent permitted by law.

14. Electronic Communications and Signatures

You consent to receive agreements, disclosures, notices, and other communications from us electronically. You agree that your electronic signature, click, or checkbox has the same legal effect as a handwritten signature under the federal E-SIGN Act and the New York Electronic Signatures and Records Act.

15. Changes to These Terms

We may update these Terms from time to time by posting the revised version on this page and updating the “Last Updated” date. Changes take effect when posted and apply to your use of the Services after that date. Changes will not apply to any Dispute of which either party had notice before the change was posted. Your continued use of the Services after changes are posted means you accept the revised Terms.

16. Privacy

Our collection and use of your information is described in our Privacy Policy, which is part of these Terms.

17. General

(a) Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Services. They do not replace any separate written agreement you sign with us or with a Funder.
(b) Severability. If any provision is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in full effect, except as stated in Section 13(d).
(c) No waiver. Our failure to enforce any provision is not a waiver of it.
(d) Assignment. You may not assign these Terms without our written consent. We may assign them without restriction.
(e) Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
(f) Survival. Sections 3 through 5 and 7 through 17 survive any termination of your use of the Services.
(g) Headings. Headings are for convenience only and do not affect interpretation.
